Conditions of Use

§ 1 Terms and Conditions
·	Terms and Conditions apply only in such form as they are publicly displayed on our website at the time of the customers order.

§ 2 Attaining an Agreement
·	The online presentation of our products does not pose a binding offer. Through sending us an order the costumer makes a binding offer, which is only accepted at the time we ship out the ordered goods. The customer receives a confirmation of his order through email. This confirmation does not statue the attainment of the agreement.
·	The agreement is attained under the circumstances of a prompt and correct delivery through our media services.
·	The agreement is subject to cancellation on our side, should it occur that ordered products are not in stock. If the product is not yet published, the order will be reserved if possible.
·	If a product is not available due to the fact that it is sold out, our costumer can choose to cancel his order or to order a reservation for upcoming reprints or new releases. In any case the customer will be notified immediately about the non- availability. All customers? costs endured up until this point will be refunded.
·	If the amount of goods ordered exceeds common trade amounts, we will eventually diminish the order to a number of pieces that do not exceed common trade amounts.
·	If the order exceeds 100 ? in value, the customer is obliged to provide an advanced payment of the value of the order. The order is processed after the transaction is registered. The same procedure applies should it occur that the sum of not yet paid shipments exceed 100 ? in value.
·	The process of ordering can be done in English and German.

§ 3 REVOCATION RIGHTS INFORMATION

	Right of Revocation
	You have the right to cancel your contract within 14 days without statement of reasons in text form (e.g. by letter, fax, e-mail) or – if the goods are placed at your disposal prior to the expiry of this period – by returning the goods. The period shall run after receipt of this information in text form, but not before receipt of the goods by the receiver (in the case of recurring delivery of similar goods not prior to the delivery of the first part delivery) nor before the fulfillment of our duties to furnish information pursuant to Art. 246 § 2 in conjunction with Art. 1 § 1 and 2 EGBGB and the information duties set out in Art.312 e § 1, Cl.1 BGB in conjunction with Art. 246 § 3 EGBGB. 	Consequences of revocation
	In the case of valid revocation the services received by either party shall be returned and any benefits that may have derived shall be returned (e.g. interests). Should you be partially or wholly unable to return the goods received from us or only to do so in deteriorated condition compensation must be paid for loss of value. This does not count if the deterioration of the goods is exclusively due to its inspection – as you could have been doing by purchasing it in a retail shop. For the rest, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use by not using the goods as your own property and refraining from all actions that may affect its value. Items suitable for delivery by parcel are to be returned at our risk. You have to bear the costs for the return of goods as far as the goods correspond to the goods ordered and the price of the returned goods does not exceed 40.00 Euros or in case of a higher price of the goods you have not yet paid the amount due or the contractually agreed upon part payment. Otherwise the return shipment is free of charge for you. Goods that cannot be sent as parcels will be picked up at your place. Obligations to refund payments must be met within 30 days. The time limit of 30 days starts with your forwarding the declaration of revocation or the goods, on our side with the date of receipt. There is no right of revocation for goods that have been produced according to customer specifications or are clearly tailored for special customer requirements or not suitable for a return shipment due to their condition.

§ 4 Delivery and Fees
·	Delivery fees within the Country of Germany (tax included):

·	Delivery fees within the area of Europe (tax included):
	Value of order up to 17 € - Fees 4,90 € Value of order up to 40 € - Fees 7,90 € Value of order over 40 € - Fees 16,00 €

·	Shipment fees of orders to be sent to area outside of Europe:
	Value of order up to 17 € - Fees 9,00 € Value of order up to 40 € - Fees 17,00 € Value of order over 40 € - Fees 25,00 €

·	The costs of shipment are displayed separately.
·	Please note the minumum order is 5.00 EUR.
·	Fotos with size over 30 x 45 cm will be delivered directly from the manufacturer.
·	Time of Delivery for all deliverable works of Edition NAAM GmbH usually consists of 8 to 10 workdays; deliveries sent abroad usually take up to 15 workdays.

§ 5 Pricing and Conditions of Payment
·	The total amount to be paid results from the price of the products ordered in addition to the shipment fees.
	All prices in Euro money contain German sale- taxes of 19% (books 7%)
·	We accept several options of payment. The applicable form of payment will be displayed during the process of ordering.
·	Payment is immediately by receiving the invoice, without subtraction of any discount (Skonto), after receipt of shipment and bill. The payment is to be wired to the on-the-bill-given bank number.
·	Payments from foreign countries have to be made by credittransfer. Please use one of the listed accounts.
·	Payments from foreign countries have to be conducted without any expenses. Deliveries abroad might bear further costs such as taxes, custom service or import fees.
·	Any default by the customer is subject to common law. Goods are property of Edition Naam GmbH until full payment.

§ 6 Guarantee
·	We provide a guarantee for default of the product, through repair or delivery of a defect- free product (called subsequent performance). Prior to any other claim we must be given an appropriate amount of time and opportunity.
·	If the subsequent performance cannot be conducted properly, the customer has the right to diminish the amount of payment of the product or to revoke the agreement.
·	Irrelevant default of the product or irrelevant defect under common use are not subject to claim of default.
·	Obvious defects are subject to claim within 2 weeks after reception of the product; otherwise the claim can not be accounted. To meet this deadline, it is sufficient to send off the product on time. Proof has to be provided by the customer. For salesmen, article 377 HGB applies.

§ 7 Property Reservation
·	For agreements with consumers it applies that we reserve property of a product until we have received full payment for the product.
·	For agreements with entrepreneurs it applies that we reserve property of a product until all of his financial obligations to us have been fulfilled by the entrepreneur.
·	As long as our reservation of property exists the customer is obliged to report to us damage or default of the product immediately.
·	By distrustful behavior of the customer, especially delay of payment, we maintain the right to take back any of the affected goods. By taking back the products we don?t revoke the agreement ? revocation of the agreement is established by seizure of the product through us.

§ 8 Data Protection
·	Data of address will be saved during process of your order according to current German law of data protection (BDSG). At Naam Edition GmbH data is basically used in connection with attaining an agreement and to process your order. Details are to be taken from the Data Protection Information
·	Correction, Blocking and deletion of Data: Customers of Edition Naam can review and edit their own user information at any time in the secured part of our homepage. For deletion of their user information customers can turn to order@edition-naam.com.


§ 9 Final Terms
·	It applies the material law of the Federal Republic of Germany. UN conventions concerning the selling of goods do not apply.
·	If the customer is a salesman, legal person of public law or public- legal fortune, all legal disputes in connection with this agreement have to be taken to the court of Augsburg. The same standards apply should the customer not be within the jurisdiction of the country of Germany.
·	Should it occur that single conditions of this agreement between us and the customer including the Terms and Conditions listed above, partly or in whole alter to the extend that they are not applicable anymore, the remaining conditions won?t alter nor is the validity of the agreement affected.

Conditions for the subscription of TRUE LIGHT:
·	One subscription term lasts one year. The subscription is automatically prolonged for one more year, if it is not cancelled in written 2 months prior to the end of the calendar year.
·	The price of one subscription consists of the price of the subscription and the shipping fees. Prices for AGermany, Austria and Foreign countries are displayed on our website.
·	On your bill, taxes are listed separately.
